How to create an Agency Agreement in Sign (NSW)
This guide explains the process for generating a compliant NSW Agency Agreement using Realtair Sign. The workflow is consistent whether your office uses REI, ADL, or EAC forms.

This guide explains how to create a compliant NSW Agency Agreement.
The process has four main steps:
- Verifying your agent profile details.
- Generating the agreement form from a campaign.
- Completing all required sections of the form.
- Generating the final document for review and sending.
Step 1: Verify your trading details (for contractors)
Before you generate an agreement, you must ensure your trading details are correct. This ensures your ABN and GST status are correctly populated on the final document.
Note: If you are an employee, you can skip this step. Your office administrator manages these details.
- Click your initials on the top right of the page.
- Select ‘Manage Profile’, then ‘Sign’.
- Confirm your ‘Trading Details’ are accurate.
- Ensure ‘GST Registered’ is set to ‘Yes’.
- Click ‘Submit’.
Step 2: Generate the agreement form
We recommend you generate an agreement from a campaign where you have already created a Pitch proposal. This will pre-fill key information.
- Open the relevant campaign from your dashboard.
- Navigate to the ‘Sign’ tab.
- Click ‘Create’ and select ‘Agency Agreement’.
This opens the digital form. The sections at the bottom of the screen act as a progress tracker. Any section marked in red is missing mandatory information.
Step 3: Complete each section of the form
Work through each section of the form. Built-in guardrails will ensure all critical fields are completed for compliance.
1. Vendor Details Vendor details will pre-fill from an existing Pitch.
- Add the vendor's full legal name in the ‘Legal Name’ field.
- Use this field for Executors or Power of Attorney details.
- For company ownership, toggle ‘Company On’ and enter the Business Name, ABN, and ACN.
2. Solicitor Details If the solicitor's details are not yet known, toggle ‘To Be Advised’.
3. Property & Inclusions
- List all known property inclusions (at least one is required).
- If the property is tenanted, toggle ‘Tenanted On’ and complete the details.
- The ‘Appraisal Date’ is a required field for the Consumer Guide.
4. Agreement Type & Key Details
- Select the ‘Agreement Type’ from the dropdown menu.
- Check that the ‘Estimated Price’ has carried over from Pitch and adjust if necessary.
- Complete the vendor pricing instructions, agreement start date, and duration.
- Use the optional toggles for Waive Cooling-Off Period, Privacy Details, and more.
Important: Toggle ‘Auto-fill empty fields with NIL’ to ‘On’. This is a critical step to ensure compliance with NSW regulations, which require that no field on the agreement is left blank.
5. Commission Commission can be a ‘Flat Dollar’ amount, a ‘Percentage’, or a ‘Tiered’ structure. GST is added automatically for REI forms.
Toggling ‘Remove Subclause D’ to ‘Yes’ will strike through the corresponding clause in the Agent’s Remuneration section.
6. Comparables Comparable properties will pull through automatically from your Pitch proposal. You can adjust or remove them here.
7. Marketing The marketing schedule from Pitch will be displayed. You can remove items by clicking the ‘X’ or add more from the ‘Library’.
8. Material Facts
- Toggle ‘Material Facts On’ to display the checklist.
- If a fact applies, toggle it ‘On’ and add relevant file notes.
- You can also use the ‘Client Fill-In’ feature to ask the vendor to complete this section.
9. Disclosures Add any required disclosures, such as a personal interest in the property. Your administrator can save standard office disclosures to have them automatically appear here.
10. Annexures
- Add standard documents from your office ‘Annexure Library’.
- Click ‘Create Annexure’ to add a custom document via file upload or text.
Step 4: Generate and review the document
Once all sections are complete, click ‘Finish’.
Your NSW Agency Agreement is now generated and ready for the final steps.
